Effective date: [TODO: effective date, e.g. 1 September 2026] · Version: 1.0
Applies to the Suki Perks mobile application and the web application at www.sukiperks.com.
1. Agreement
By creating an account or using Suki Perks, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.
You must be at least 18 years old and legally able to enter into a contract.
2. What Suki Perks is
Suki Perks is a platform that connects you with independent businesses and independent delivery riders. It is important that you understand what this means:
- We are not the seller. Businesses sell their own goods and services. Your purchase contract is with the business.
- We are not the delivery provider. Riders are independent contractors who provide delivery services.
- We provide the technology that lets you find businesses, place orders, pay, track delivery, and earn loyalty points.
We are responsible for the platform working as described. We are not the manufacturer, seller, or preparer of the goods you buy.
3. Your account
3.1 Registration
You must provide accurate information and verify your mobile number by SMS. You are responsible for keeping your credentials secure and for all activity under your account. Tell us immediately if you suspect unauthorised access.
3.2 One account per person
You may hold one customer account. Creating multiple accounts to abuse promotions, delivery perks, or loyalty points is grounds for suspension and forfeiture of points.
3.3 Suspension and termination
We may suspend or terminate your account if you breach these Terms, if we reasonably suspect fraud or abuse, if you repeatedly refuse delivery of orders you placed, or if we are required to by law.
Where practical we will tell you why and give you an opportunity to respond. Suspension for suspected fraud is reviewed by a person before it takes effect.
You may close your account at any time in the app.
4. Orders
4.1 Placing an order
An order is an offer to buy from the business. The contract forms when the business accepts it. We are not a party to it.
Order details, prices, and availability are provided by businesses. We take reasonable steps to display them accurately but do not warrant that they are error-free.
4.2 Fulfilment methods
| Method | What it means |
|---|---|
| Walk-in | You go to the business; dine in or be served there |
| Pickup | You collect your order from the business |
| Delivery | A rider brings your order to your address |
| Appointment | You book a service at a scheduled time |
| Home service | A service partner travels to your location, where they offer it |
4.3 Notes and special requests
You can attach a note to an individual item ("no spicy", "remove onions") or to the order as a whole. Notes are passed to the business, shown on their screen, and printed on their ticket.
A note is a request, not a guarantee. The business may be unable to honour it — an ingredient may already be in a pre-made dish, or they may be out of an alternative. A business who cannot meet a request should tell you through in-app chat, but a request that was not met is not by itself grounds for a refund.
If you have a serious allergy, do not rely on a note. Message the business to confirm before you order. As set out in section 12, food safety and allergens are the business's responsibility, and we are not in a position to verify what any kitchen does.
Notes must relate to preparing your order. Do not use them to send contact details, payment information, or anything abusive.
4.4 Prices and fees
Prices are set by businesses and shown in Philippine Pesos.
Your total may include:
| Charge | When |
|---|---|
| Item prices | Always |
| Delivery fee | Delivery orders. Based on distance, item count, and any promotion in effect |
| Payment service fee | Online payments only, currently 3% of the order (minimum ₱10). Covers payment processing. Never charged on cash orders |
All fees are shown before you confirm. We verify all prices on our servers — the amount you are charged is calculated by us from the business's listed prices, not by your device.
We may change fees. Material changes are notified at least 30 days in advance.
4.5 Cancellation
| When | Who can cancel |
|---|---|
| Before the business accepts | You, in the app, free of charge |
| After the business accepts | The business only — contact them through in-app chat to request it |
| Any time | The business, if they cannot fulfil the order |
Once a business accepts, they may have started preparing your order and a rider may have committed to the delivery. That is why self-cancellation ends at that point.
If a business cancels a paid online order, you receive a full refund automatically, including the payment service fee. No cancellation fee is charged to you at any point.
5. Payment
5.1 Methods
| Method | Notes |
|---|---|
| Cash on Delivery / Pay in Person | Pay the business or rider directly |
| Online — QR Ph, GCash, Maya, bank transfer | Processed by PayMongo |
5.2 Online payment
Your order is created only after your payment is confirmed. If you start a payment and do not complete it, no order is placed and the business never sees it.
We never see or store your card or e-wallet credentials.
5.3 Cash
Pay the exact amount where possible. Riders may not carry change. Repeatedly refusing to pay for or accept cash orders may result in suspension.
5.4 Failed payments
If your payment is taken but your order does not appear, contact support@sukiperks.com with the payment reference. We will investigate and either complete your order or refund you in full.
6. Refunds
6.1 Automatic refunds
If a paid online order is cancelled, we automatically refund the full amount, including the payment service fee, to your original payment method.
6.2 Requesting a refund
Contact us within 24 hours of delivery or pickup if items are missing, items are materially different from what you ordered, items arrive in unacceptable condition, or the order was never delivered.
Provide your order number and, where relevant, photographs. We may issue a full or partial refund depending on what went wrong — for example, a refund of the missing items rather than the whole order.
6.3 Timing
Refunds are issued to your original payment method. Your bank or e-wallet provider may take 5–10 business days to show the credit. That timing is outside our control.
Refunds are never issued as loyalty points or business credit unless you ask for that instead.
6.4 What is not refundable
- Change of mind after the business has accepted
- Failure to be available for a delivery you scheduled
- An incorrect address you provided
- Items consumed or used before reporting the problem
Nothing here limits your rights under the Consumer Act of the Philippines.
7. Delivery
7.1 Riders are independent contractors
They are not our employees. We facilitate the connection and handle the payment.
7.2 Your responsibilities
- Provide an accurate, complete, reachable address.
- Be available at the delivery address.
- Keep your phone reachable.
- Provide safe access.
If a rider cannot reach you after reasonable attempts, the order may be returned and you may not be entitled to a refund.
7.3 Delivery times
Estimates are estimates. Traffic, weather, and business preparation time affect them. We do not guarantee a delivery time.
7.4 Tracking
You can follow your delivery in the app while it is in progress. Tracking ends when the delivery completes.
8. Loyalty points
8.1 How they work
You earn points on qualifying purchases. Points are earned at, and can be redeemed at, the specific business that issued them — they are not transferable between businesses.
Each business sets their own earning rate, which is shown on their business page.
8.2 What points are — and are not
Points have no cash value. They are not currency, not property, and not transferable. They cannot be sold, gifted, exchanged for cash, or transferred between accounts.
8.3 Earning
Points are awarded when an order is completed. Points are calculated on the item subtotal — not on delivery fees or service fees. Cancelled and refunded orders do not earn points; points already awarded for a refunded order are reversed.
8.4 Redeeming
Redeem points for eligible items at the issuing business. The business confirms each redemption. Redeemed points are deducted when the redemption is confirmed.
8.5 Expiry
Points expire after 12 months without any earning or redemption activity at that business. We will notify you in the app and by email at least 30 days before points are due to expire, so you have time to use them.
8.6 Forfeiture
Points are forfeited if your account is closed, if we determine they were obtained through fraud, error, or abuse, or if a business leaves the platform. Where practical we will give notice so you can redeem first.
8.7 Changes
We may change the loyalty programme. Material changes will be notified at least 30 days in advance. We will not reduce points you have already earned.
9. Reviews and content
9.1 Your content
You may post reviews and ratings for products you bought and riders who delivered to you. You keep ownership; you grant us a worldwide, royalty-free licence to display and distribute it in connection with the service.
9.2 Rules
Do not post anything false or misleading, defamatory, obscene, hateful, harassing, someone else's personal information, spam, or content that infringes someone's rights.
9.3 Moderation
We may remove content that breaches these rules. We do not routinely pre-screen reviews, and we do not remove a review simply because a business dislikes it.
9.4 One review per purchase
You may review each item and rider on a completed order once.
10. Acceptable use
You must not:
- use the service for an unlawful purpose;
- create multiple accounts to abuse promotions or points;
- attempt to manipulate points, prices, fees, or ratings;
- reverse engineer, decompile, or tamper with the apps;
- access the service through anything other than our official apps and website;
- scrape, harvest, or bulk-download data;
- interfere with the service or place unreasonable load on it;
- harass, threaten, or abuse businesses, riders, or our staff;
- impersonate anyone.
Attempting to obtain loyalty points, discounts, or goods you have not paid for is fraud. We will suspend the account, reverse the benefit, and may pursue legal remedies.
11. Intellectual property
The Suki name, logo, apps, website, and content are owned by us or our licensors and protected by intellectual property law. You get a limited, non-exclusive, non-transferable, revocable licence to use the apps for personal, non-commercial purposes.
Business names, logos, and product images belong to those businesses.
12. Disclaimers
To the fullest extent permitted by Philippine law:
- The service is provided "as is" and "as available".
- We do not warrant that it will be uninterrupted, error-free, or secure.
- We do not warrant the quality, safety, legality, or fitness of goods sold by businesses.
- We are not responsible for food safety, allergens, or product quality — that is the business's responsibility. If you have allergies or dietary requirements, confirm directly with the business before ordering.
- We do not warrant the conduct of businesses or riders.
Nothing in these Terms excludes any right you have under the Consumer Act of the Philippines (RA 7394) or any other law that cannot be excluded by agreement.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages; for loss of profits, data, or goodwill; for the acts or omissions of businesses or riders; or for matters beyond our reasonable control.
Our total liability for any claim relating to an order is limited to the amount you paid for that order.
These limits do not apply to death or personal injury caused by our negligence, to fraud, or to any liability that cannot be limited by law.
14. Indemnity
You agree to indemnify us against claims arising from your breach of these Terms, your violation of any law, your infringement of another's rights, or content you post.
15. Disputes
15.1 With a business or rider
Contact them through in-app chat first. If that does not resolve it, contact our support team and we will help mediate — though we are not a party to your contract with them.
15.2 With us
Contact support@sukiperks.com first. We aim to resolve complaints within 15 business days.
15.3 Governing law
These Terms are governed by the laws of the Republic of the Philippines. Any dispute not resolved informally is subject to the exclusive jurisdiction of [TODO: court venue, e.g. the courts of Cebu City].
Nothing in this section prevents you from bringing a complaint before the Department of Trade and Industry or any other body with jurisdiction over consumer matters.
16. Changes
We may update these Terms. Material changes will be notified in-app and by email at least 30 days before they take effect. Continuing to use the service after that means you accept them. If you do not accept, close your account.
17. General
Entire agreement. These Terms and the Privacy Policy are the entire agreement between us.
Severability. If a provision is unenforceable, the rest remain in effect.
No waiver. Not enforcing a provision does not waive it.
Assignment. You may not assign these Terms. We may assign them to a successor.
Force majeure. Neither party is liable for failure caused by events beyond reasonable control, including natural disasters, typhoons, government action, and network failures.
Language. These Terms are in English. Any translation is for convenience; the English version governs.
